Terms and Conditions:
Our Contracts
1. All our contracts with customers are on these conditions to the exclusion of all other terms and conditions.
2. These conditions apply to all Fabulous & French's sales and any variation to these conditions and any representations about the goods shall have no effect unless expressly agreed in writing and signed by a duly authorised officer of Fabulous & French. By making an order the customer acknowledges that it has not relied on any statement, promise or representation made or given by or on behalf of Fabulous & French, which is not set out in the contract. Nothing in this condition shall exclude or limit Fabulous & French's liability for fraudulent misrepresentation.
3. Each order by the customer shall be deemed to be an offer by the Customer to buy the goods subject to these conditions.
4. The contract shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.
Purchases / Orders
1. After placing an order, you will receive an 'Order Acknowledgement' e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an 'Order Confirmation' e-mail that confirms that the product is in stock, when the product will be delivered or will be ready for collection. If the product is out of stock we will inform you of the lead-time for delivery in the 'Order Confirmation' e-mail also. The contract between us will only be formed when we send you the Order Confirmation.
2. All prices on our website include 15% VAT but exclude the delivery charge, which will be added to the total amount due at the checkout. The delivery charge is calculated on your geographic area as well as the volume of goods being dispatched. For full details on our delivery charges please view our delivery section.
3. Our reproduction furniture is hand-made and as such the order time for goods out of stock can be between 4-16 weeks. We aim to be as accurate as we can with delivery estimates but they are not binding. Delays may occur in shipping which we have no control of and we ask our customers to be patient should unforeseen delays occur.
4. We try to show products on the Website as accurately as possible. Despite this, slight variations may occur. For example the colour of the product may vary in accordance with the settings of your computer, monitor, software or printer from the colour of the actual product you receive.
5. All sizes of products specified on the Website are approximate only. As most of our products are hand-made, their actual sizes can be up to 2 cm larger or smaller than specified on the Website and we ask you to take account of this when carrying out your measurements and/or considering whether to purchase a particular product.
Refunds
1. Customers are entitled to a full refund (but not later than 7 working days after the day after you receive the goods) by sending a written notice of cancellation to us (or as otherwise provided by law). In such event the customer is liable to pay for the cost of returning the goods. The goods must be returned to Fabulous & French in the condition they were delivered in before a full refund is issued.
2. Refunds will not be given for any specialist orders. For example, products, which we have upholstered in the fabric of your choice.
3. Fabulous & French will refund any damages reported within 24 hours of delivery. Fabulous & French will then aim either to replace the damaged item immediately or, if this is not possible as a replacement is out of stock, to give a full refund.
4. Fabulous & French will not refund goods simply because they do not match, suit or fit or because they are unsuitable to the position the customer envisaged. Each piece is ordered for you and cannot be returned to the manufacturer. We ask all our customers to check their measurements and access to avoid disappointment.
5. When you return a product to us because you have cancelled the Contract within the statutory seven-day cooling-off period (see Refunds, point 1 above) we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you gave us notice of your cancellation. In such a case, we will refund the price of the product in full, including the cost of delivery of the product. However, you will be responsible for the cost of returning the product to us or us collecting it from you. We will deduct the cost of collection (which will be the same amount as the delivery charge) from the total refund amount due to you.
Delivery
1. Two delivery persons only ever make deliveries.
2. The majority of deliveries are made by Fabulous & French. For longer distance deliveries we outsource our deliveries to a local, specialist, furniture delivery company. Days and times for delivery are estimates only and shall not be made of the essence by notice.
3. On delivery you will be asked to sign a delivery note to say that the goods have been received in good order and that all ordered goods have been delivered. If there is not sufficient time to check goods for damages we ask that customers inform us within 24 hours of damages so that a replacement can be sent out or a refund can be given.
4. Goods will only be brought to the room of your choice on the ground floor of your property. The outer packaging of your furniture (cardboard box) will be removed for your convenience. The packaging on the products themselves (corrugated cardboard) is the responsibility of the customers to remove.
5. Fabulous & French are able to take goods upstairs and offer a basic assembly service (where tools are not required) for an additional fee of £40.
6. It is the customer's responsibility to ensure that all ordered goods fit into the home and that there is no restricted access. The customer will need to measure doorways and staircase access that the goods will need to pass through. Customers will need to take into consideration space to adequately manoeuvre the goods as well. Fabulous & French cannot accept refunds for goods that cannot fit into the home or cannot be delivered due to access, unsuitability or any fault of the customer. The dimensions of the goods we deliver are approximate only. As most of the products are hand-made the customer will need to take this into consideration when measuring also.
7. Subject to the other provisions of these conditions Fabulous & French shall not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery, nor shall any delay entitle the customer to terminate or rescind the contract, unless such delay exceeds 180 days.
8. If for any reason the customer fails to accept delivery of any of the goods when they are delivered or Fabulous & French is unable to deliver the goods on time (because the customer has not provided appropriate access, instructions, documents, licences or authorisations) risk in the goods shall pass to the customer (including for loss or damage caused by Fabulous & French's negligence); the goods shall be deemed to have been delivered; and Fabulous & French may, but need not, store the goods until delivery, and if it does provide such storage, the customer shall be liable for all related costs and expenses (including, without limitation, storage and insurance) at a cost of £20 per fortnight.
9. Delivery will be made to the address specified on your order. When you are at the 'Checkout' you will be given the option of choosing either delivery or collection. Should you wish to collect, our collection address and contact details can be found in our delivery details section.
10. We aim to fulfill your order within the delivery period set out in the Order Confirmation unless there are circumstances beyond our control, which prevent us from doing so. We shall contact you to let you know if we are having problems getting an item to you within the specified delivery period.

Risk / Title
1. The goods are at the risk of the customer from the time of delivery or attempted delivery.
2. Ownership of the goods shall not pass to the customer until Fabulous & French has received in full all sums due to it in respect of the goods; and all other sums which are or which become due to Fabulous & French from the customer on any account.
Care
1. We recommend our painted furniture be kept out of direct sunlight to avoid the paint colour fading and use of a damp cloth for cleaning. Because the furniture is painted, cracks and chips may appear in time but this is quite normal for wood furniture and should enhance the appearance.
2. We create an aged effect on some of our goods. Any stains, cracks and chipped paint are part of the desired effect and should not be considered a defect.
Limitation of Liability
1. All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are, to the fullest extent permitted by law, excluded from the contract.
2. Nothing in these conditions excludes or limits the liability of Fabulous & French: 1 for death or personal injury caused by Fabulous & French's negligence; or under section 2(3), Consumer Protection Act 1987; or for any matter which it would be illegal for Fabulous & French to exclude or attempt to exclude its liability; or for fraud or fraudulent misrepresentation.
3. Subject to the above Fabulous & French's total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the contract shall be limited to the contract price; and Fabulous & French shall not be liable to the customer for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the contract.
Force Majeure
Fabulous & French reserves the right to defer the date of delivery or to cancel the contract (without liability to the customer) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of Fabulous & French.
